4) By entering this promotion, entrants agree to be bound by these Terms and Conditions.
5) The Promoter reserves the right to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions.
6) The Promoter reserves the right to cancel or amend the promotion if circumstances arise outside of its control.
7)The prize is not transferable, exchangeable, or redeemable for cash.
8) The Promoter’s decision is final, and no correspondence will be entered into.
9) The Promoter is not liable for any loss or damage suffered or sustained as a result of taking or using the prize, except for liability which cannot be excluded by law.

Method of Entry:

The Promotion must be entered by submitting an entry using the online form provided at https://gleam.io/ORNTT/win-a-garmin-vivoactive-5-smart-watch-valued-at-499 and pass any verification requirements (email or fraud score) set by the Promotor. The Entry must fulfil all requirements of the Promotion, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications of the Promotion may be disqualified at the sole discretion of the Promotor. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Promotion, your submission may be disqualified at the sole discretion of the Promotor.

Each purchase must remain valid at time of draw. Purchases that are unvalidated, returned and/or refunded at the time of draw will be excluded from entry.

Notification of Winners:

The Winner will be selected by Random Draw under the supervision of the Promoter. The winner will be notified via email within 2 business days of the draw and will have their name published on the official FILA Australia Instagram page (@fila_australia) within 5 business days of the draw. The Promotor shall have no liability for a Winner's failure to receive notices due to spam, junk e-mail or other security settings or for a Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner cannot be contacted, is ineligible, fails to claim the prize within fourteen (14) days, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt of the prize offered in this Campaign by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these official rules by the Winner at the Promoter’s sole discretion will result in the Winner's disqualification as winner, and all privileges as winner will be immediately terminated.

Unclaimed Prize Draw:
Winners must provide their full name, contact number and delivery address for prize allocation. If the prize has not been claimed by the winner in fourteen (14) days the winner will be redrawn.

If the subsequent winner does not claim to prize within seven (7) business days, the prize will be forfeited.

General Terms and Conditions

1) The Schedule forms part of these Terms and Conditions (Terms of Entry). Where there is any inconsistency between these Terms and the Schedule, the Schedule prevails. Participation in this Promotion is deemed acceptance of these Terms of Entry.

2) By entering the Promotion, the contestant ("You") agree to comply with and abide by these Rules and the decisions of the Promotor, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Promotor’s decisions as final and binding as it relates to the content of this campaign.

The Promotion is only open to legal residents of Australia, and is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of FILA Australia (the "Promotor") their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

4) The Promotion will be conducted during the Promotion Period.

6) Total Prize Value: $499 AUD (incl. GST). Actual/appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Promoter. No cash or other prize substitution shall be permitted except for at the Promoter’s discretion. The prize is non-transferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. Acceptance of the prize constitutes permission for the Promoter to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

7) The prize is valued in Australian dollars unless expressly stated otherwise.

8) The odds of winning depend on the number of eligible entries received.

9) Entrants are advised that tax and financial implications may arise from winning a prize and should seek independent advice before accepting. The Promoter accepts no responsibility for any such implications.

10) Entrants are responsible for any expenses incurred in entering and will not be reimbursed regardless of the competition outcome.

11) To enter, entrants must comply with the Method of Entry in the Schedule.

12) The time of entry will be deemed to be when the Promoter receives the entry.

13) The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted or misdirected entries.

14) The winner does not need to be present at the draw.

15) Winners will be notified and published as stated in the Schedule.

16) By entering, entrants warrant that all information is true, complete and that they own all rights to their entry. It is the entrant’s responsibility to update the Promoter if contact details change.

If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless FILA Australia from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which FILA Australia may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

18) It is a condition of accepting the prize that the winner complies with all conditions of use and supplier requirements.

19) Prizes are not transferable, exchangeable, or redeemable for cash.

20) To the extent permitted by law, the Promoter excludes all warranties and is not liable for any loss or damage suffered in connection with the Promotion or Prize.

21) If the Promotion is prevented or hindered by outside events (e.g., natural disaster, strike, civil unrest), the Promoter may cancel or restart the Promotion.

22) Entrants consent to the Promoter using their personal information for the purposes of the Promotion, including sharing it with third parties involved.

23) The Promotion is governed by the laws of the entrant’s State/Territory of residence.

24) This Promotion is not sponsored, endorsed, or administered by, or associated with, Garmin, Facebook or Instagram.

25) The Promotor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion should virus, bug, non-authorised human intervention, fraud, or other cause beyond the Promotor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Promotion. In such cases, the Promotor may select a winner(s) from eligible entries received before and/or after the action taken by the Promotor if appropriate. The Promotor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms & Conditions. The Promotor has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Promotion rules; or the use of bots, macros, scripts, or other technical means for entering. 26) Limitation of Liability: By entering the Promotion you agree to release and hold harmless FILA Australia and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorised human intervention in any part of the Promotion; (iii) electronic or human error in the administration of the Promotion or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

 27) Disputes: This Promotion is governed by the laws of Australia, without respect to conflict of law doctrines. By participating in this Promotion, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Australia having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Promotion). You further waives all rights to have damages multiplied or increased.

You understand that you are providing your information to the owner of the Promotion and not to Facebook, X, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks.
