Official Rules – “Win $1K Worth Of FILA Gear to split between you and a friend” Promotion

Definitions

  • Promotion refers to the referral competition outlined in Clause 2 of these Rules. 
  • Start Date: Wednesday, 17 April 2025, at 12 PM AEST. 
  • End Date: Wednesday, 30 April 2025, at 2 PM AEST. 
  • Promotion Duration refers to the period between the Start and End Dates, as detailed in Clause 4. 
  • Original Participant means any eligible individual who submits an entry in line with Clause 6. 
  • Referred Friend refers to the person/profile tagged by the Original Participant to join the Promotion. 
  • Prize comprises two FILA Australia online store vouchers valued at $500 each – one for the Original Participant and one for the Referred Friend. Each voucher can only be redeemed online (www.fila.com.au). Vouchers are valid for 36 months from date of issue.
  • Organiser refers to SM Brands Pty Ltd t/a FILA Australia, 46 Barrie Road Tullamarine VIC 3043.
  • Entry Pair has the meaning set forth in Clause 8.

1.       Participation and prize details form part of these conditions. Entry signifies agreement to all terms.

2.       The Promotion is open to legal residents of Australia aged 16 or older as of the Promotion’s Start Date, excluding:
   - Employees of the Organiser and its affiliates,
   - Household members of said employees,
   - Immediate family members of employees.

3.       No purchase is necessary to enter. All participants must comply with applicable laws.

4.       The Promotion runs from the Start Date to the End Date.

5.       The Promotion is hosted on the website: https://www.fila.com.au

6.       To participate, an Original Participant must follow the instructions within the original Instagram post before the End Date:

-          Like the original competition post from @fila_australia

-          Tag the Referred Friend the comments section (Instagram username required)

-          The Entry Pair must also be following the official @fila_australia Instagram account

7.       A valid entry into the prize draw requires that both the Original Participant and the Referred Friend follow @fila_australia on Instagram. This duo is considered an "Entry Pair." A maximum of 50 Entry Pairs is allowed per Original Participant.

8.       The Referred Friend can also tag their own friends, to form a new Entry Pair, as long as they like the original Instagram post and both parties follow @fila_australia on Instagram.

9.       Entry also confirms agreement to FILA Australia's Privacy Policy and Terms & Conditions.

10.   Participants may only form one Entry Pair with each friend. Duplicate entries using multiple Instagram profiles or aliases are considered tampering and will be disqualified.

11.   Entries that are incomplete, incorrect, or otherwise non-compliant may be rejected.

12.   A random draw will select the winning Entry Pair from all eligible entries. The draw will be held on Wednesday 14th May 2025, at the Organizer’s premises and will not be open to the public. Winners will be published on the official FILA Australia Instagram page (@fila_australia) and a direct message will be sent to the winning participants (using the profiles used to enter. Both participants must reply to claim the prize.

13.   The draw process will be impartial and transparent. The Organiser’s decision is final.

14.   If a prize is unclaimed by May 22, 2025, an alternate draw will occur on May 23, 2025, with winners notified within 24 hours. Updated results will be published online the same day.

15.   Each member of the winning Entry Pair will receive a $500 online voucher for use on www.fila.com.au.

16.   Total prize pool is valued at AUD $1,000.

17.   Prizes are non-transferable and cannot be exchanged for cash. Odds of winning depend on the number of valid entries. Winners must cooperate with FILA Australia for any promotional use of their name or image.

18.   This Promotion may be advertised on third-party platforms like Instagram. Such platforms are not affiliated with the Promotion. Participants must comply with third-party terms.

19.   Any entrant providing false information or failing to meet eligibility criteria may be disqualified. The Organiser may request identification to verify eligibility.

20.   Entrants are responsible for internet access costs. Incorrectly entered contact information may render entries void.

21.   The Organiser is not responsible for technical issues that disrupt participation. In the event of unforeseen disruptions, the Organiser may cancel or modify the Promotion.

22.   To the extent allowed by law, the Organiser and affiliates are not liable for any injury or loss arising from participation or prize use.

23.   If any part of these rules is invalid, the rest remains in effect.

24.   The prize pool does not require a permit in Australia due to its total value.

25.   Personal data collected during the Promotion is used for administration and marketing purposes as outlined in the Privacy Policy.

26.   These rules are governed by Victorian law. Legal disputes will be handled in Australian courts.

27.   The Organiser reserves the right to verify entries and disqualify any that breach these rules.

28.   Tampering with the entry process will lead to disqualification.

29.   Minor errors may be overlooked at the Organiser’s discretion. Non-enforcement of a rule does not waive the Organiser’s rights.

30.   Once awarded, prizes are final and non-exchangeable unless:
    - The item is faulty or not fit for purpose, or
    - An incorrect size is delivered (in which case, a refund voucher will be issued).

31.   Winners consent to the use of their names and likenesses for promotional purposes without further compensation.

32.   The Organiser may share entrant data with partners for marketing or administrative reasons. Entrants may contact the Organiser for access to or correction of their data.

33.   In case of disruption or interference, the Organiser may amend or cancel the Promotion, disqualify entries, or take other actions as necessary.

34.   Except where prohibited by law, the Organiser is not liable for:
    - Unauthorised access or third-party interference,
    - Lost or late entries,
    - Prize value discrepancies,
    - Tax obligations incurred by winners.

35.   By entering, participants agree to receive ongoing marketing communications from the Organiser.
